Terms of Service

Business Near Me (businessnearme.info) is operated by Advisors Marketing & SEO ("we", "us"). These terms apply to everyone who uses the site: visitors, reviewers and business owners. By using the site you agree to them.

1. What the Directory Is

Business Near Me is a free directory of local businesses. Listings start from public records, such as state contractor license lists, and from businesses that add themselves. We show license information as it appears in state records on the date we checked. We don't guarantee the work, prices, licensing or conduct of any business listed. Check a business yourself before you hire it.

2. Accounts

• You sign in with a link we email you. Keep access to your email account secure; anyone who can open your email can sign in as you.
• You must be at least 18 to create an account.
• Give accurate information and keep it up to date.

3. Claiming and Managing a Listing

• Claim a listing only if you own the business or are authorized to manage it. We verify claims by email or by document review, and we can remove access if a claim turns out to be false.
• You're responsible for what you post on your listing: answers, hours, photos and links. It must be accurate and must not infringe anyone's rights. Photos go live when you upload them and must show your own business, with no nudity or sexual content, no graphic or violent images and no hate symbols.
• You give us a non-exclusive, royalty-free license to display, format and share the content you post on your listing, including in search results and AI answer engines that reference the site, for as long as it's on the site.
• Business names and license details come from state records and can only be changed through us.
• When you claim or add a listing, you agree that Business Near Me and its partner Advisors Marketing may email you about marketing services for your business, such as search visibility, advertising and websites. You can unsubscribe anytime using the link in any of these emails. Unsubscribing doesn't affect your free listing.

4. Listing Eligibility

Business Near Me lists local businesses that serve the public. We don't list these types of business, whether a listing comes from public records or an owner adds it:

• Adult or sexual services: escort services, strip clubs and gentlemen's clubs, adult stores and erotic or sensual massage.
• Cannabis, hemp, vape or kratom businesses: marijuana and cannabis dispensaries and delivery, CBD, THC, delta-8 and hemp products, kratom, and vape, smoke and hookah shops.
• Gambling businesses: casinos, sportsbooks and sports betting, and online gambling.
• High-risk money services: credit repair, debt relief and debt settlement, payday and car title loans, check cashing, crypto and forex investing, and multi-level marketing or get-rich offers.
• Psychic or fortune-telling services: psychics, fortune tellers, tarot and palm readers and astrologers.
• Marketing, advertising or web design companies: marketing and digital marketing agencies, SEO agencies, social media marketing, digital advertising and ad agencies, and web design companies.

We decide this by the type of business, never by who owns it. Our operator, Advisors Marketing & SEO, keeps its own listing. We can also decline or remove any other listing at our discretion, including a business we believe is unlawful, misleading or unsafe. If we remove a listing that has a paid plan under this section, and not because it broke these terms, we refund the unused part of that plan.

5. Reviews

Reviews must follow our Review Policy. Business owners can reply to and report reviews but can't edit or delete them.

6. Paid Features

• A Premium Profile costs $29 per month or $290 per year, billed in advance through Stripe and renewing automatically until you cancel. Cancel anytime from your dashboard; your Premium Profile stays on until the end of the period you paid for. We don't give partial refunds for unused time unless the law requires it.
• If a payment fails, Stripe will retry it. If it isn't paid, the Premium Profile turns off at the end of the period. Quote requests you already received stay in your dashboard.
• The one-page website has its own terms in section 7.
• Premium Profile placement affects where your listing appears in category and neighborhood pages. It never affects reviews, ratings or editorial best-of lists.
• We may change prices with at least 30 days' notice before your next renewal.

7. Website Service

• Price. The one-page website costs $299 up front, plus $29 per month for hosting and upkeep, billed through Stripe.
• Term. Hosting has a 12-month term that starts on the day you check out. After that it continues month to month until you cancel, and stays on until the end of the month you've paid for.
• Cancelling early. If you cancel during the first 12 months, you pay the hosting fee for the months left in that term.
• Timeline. Your website goes live within one week of checkout. A person on our team checks every site before it goes live.
• Domains bought through us. The first year is charged at checkout. After that the domain renews automatically each year at the renewal price shown at checkout, charged to your card on file a few days before the year ends. To stop renewing, contact us before that charge.
• Changes after launch. We make changes for you at $50 per hour, with a half-hour minimum. There is no self-service editor.
• Ownership. Your website and any domain you buy through us are yours. The address we give you for free (yourname.bnmsites.com) belongs to us and stays with your site only while it's hosted with us.
• Moving to another host. You can move your website to any compatible host at any time. We transfer your site's code repository and any domain you bought through us, for a one-time fee of $50. To move a site that uses only the free address, you'll need your own domain at the new host. After you move or cancel, we redirect your free address to your new website for 30 days.
• Template code. The design and code we built your website from are licensed to you for that website. You can't resell them or use them to build other websites.
• At checkout you confirm the term and the transfer fee by ticking two boxes. We keep a record of what you agreed to and when.

8. Acceptable Use

Don't:

• Copy, scrape or harvest listings or contact details by automated means, or use the site to build a competing list or a mailing list.
• Post false, misleading, defamatory or unlawful content, or impersonate someone else.
• Try to get around rate limits, security checks or access controls, or interfere with the site's operation.
• Send quote requests that aren't genuine, or use quote requests to sell to the business.

9. Removal and Suspension

We can edit, hide or remove listings, reviews, photos or accounts that break these terms or the law, that aren't eligible under section 4, or that we reasonably believe are harmful. Unclaimed listings can be removed on request through the link on the listing.

10. Disclaimers

The site is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. Information on listings comes from public records and from businesses themselves and may be out of date.

11. Limitation of Liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for anything a listed business does or fails to do. Our total liability for any claim relating to the site is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

12. Indemnity

If you post content or run a business listed on the site, you agree to cover our reasonable costs if a third party brings a claim against us because of your content or your breach of these terms.

13. Governing Law

These terms are governed by the laws of the State of Nevada. Any dispute will be handled in the state or federal courts located in Clark County, Nevada, unless the law where you live gives you the right to bring it elsewhere.

14. Changes

We may update these terms. If a change is significant, we'll post it here and email account holders before it takes effect. Continuing to use the site after that means you accept the updated terms.
